Complaint Review
Our insurance and product expertise allows ASI to provide a thorough review of the plaintiff’s complaint. This includes reviewing all allegations, identifying allegations that require actuarial examinations, identifying and prioritizing potential disputes, and identifying potential amendments and additions, such as overlooked allegations. Of course, this review would be conducted under counsel’s strict guidance to maintain privilege and safeguard communications and data.
Actuarial Methodology and Assumption Review
Our team of FSAs can provide a thorough analysis of the actuarial aspects of the complaint. This includes verifying calculations, examining assumptions, determining sensitivity of results to alternative assumptions, and analyzing methodologies relative to requirements and common practices. Our team can also review contract terms, regulatory requirements, statutory accounting practices and principles, financial reporting standards, actuarial standards of practice, and current and past practices.
Support Mediation, Arbitration, and Negotiations
ASI has the tools and skills to estimate the magnitude of alleged damages. Our team can identify the critical elements, assumptions and methodologies applied by the plaintiff; identify omissions, inconsistencies, biases, and costs; model the plaintiff’s estimate; and analyze the sensitivities of results to alternative assumptions and methodologies. We can also estimate the cost of proposed settlements, suggest and design settlement offers, identify settlement administration requirements and costs, and model costs. We can prepare data in support of cost estimates of proposed settlements, and prepare filings, data, and cost estimates of the negotiated settlement for examination by regulators and the court.
